In consideration for my being permitted to participate in the Lead-Free Hunting Oregon Ammunition Testing Program, I make the following representations and agree to the following Waiver, Release and Indemnity:

  1. Representations.

• I represent that I am experienced and skilled in the proper handling, loading, use, and discharge of all firearms I intend to use in the Lead-free Hunting Oregon Ammunition Testing Program; 

• I represent that I understand and will comply with the rules and regulations of the shooting facility at which  Lead-free Hunting Oregon Ammunition Testing Program takes place; and I believe that I am in appropriate physical condition. 

• I understand and acknowledge that the shooting facility at which the Lead-free Hunting Oregon Ammunition Testing Program takes place is a location where firearms discharge deadly ammunition. 

• I understand that the discharging of firearms and ammunition has inherent risks, hazards, and dangers that no amount of care, instruction, or expertise can eliminate. 

• I understand that the Oregon Zoo is specifically relying on the truth of my representations concerning my experience with firearms, knowledge of the rules and regulations of the shooting facility, and understanding of the risks in permitting me to participate in the Lead-free Hunting Oregon Ammunition Testing Program   

• I have made an independent evaluation of the risks associated with my participation in the  Lead-free Hunting Oregon Ammunition Testing Program and acknowledge that participating in an ammunition testing program has inherent risks, hazards, and dangers that cannot be eliminated. I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE, WITHOUT LIMITATION: malfunctioning firearms, inclement weather, poisonous wildlife, rugged terrain, fire, burns, blindness, hearing loss, paralysis, loss of property, property damage, personal injury to self, personal injury to others, and death.  

 2. Waiver and Release. I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISKS OF PROPERTY DAMAGE, PERSONAL INJURY OR DEATH SUSTAINED WHILE PARTICIPATING IN THE LEAD-FREE HUNTING OREGON AMMUNITION TESTING PROGRAM. I, for myself, my heirs, successors, executors, and subrogees hereby KNOWINGLY AND INTENTIONALLY AND FOREVER WAIVE ALL CLAIMS AND RELEASE AND DISCHARGE OREGON ZOO and their officers, employees, volunteers and agents from any and all liability for property damage, personal injury, and/or death sustained while participating in the Lead-Free Hunting Oregon Ammunition Testing Program and/or using ammunition or equipment provided by the OREGON ZOO. I further agree that any verbal representations, statements, or inducements apart from this Agreement will be effective only if in writing and signed by both parties.

3. Indemnity. I agree to indemnify, defend, and hold harmless the Oregon Zoo and its officers, employees, volunteers, and agents from and against any and all liabilities, damages, claims, suits, judgments, costs, and expenses (including attorney's fees) arising on account of personal injury, death, or damage *including myself and third parties) or loss of property or profits arising out of or resulting in whole or in part from, or in connection with, my participation in the Lead-Free Hunting Oregon ammunition Testing Program. My indemnification shall apply unless such damage or injury results from the sole negligence or willful misconduct of the Zoo. I agree to this indemnification and hold harmless for myself, my successors, assigns, heirs, executors, and administrators, and any other person or entity(ies) who/which may have a claim based upon my personal injuries and/or property damage.
